REFUNDS & RETURNS POLICY
GMA Cards Pty Ltd A.C.N.169 722 267 as trustee for GMA Cards Trust trading as Newborn Posing A.B.N.24 989 551 791 (we, us, our, or Newborn Posing) makes every effort to be fully transparent at all times. Accordingly, we have developed this Refunds & Returns Policy to ensure that you are fully aware of your rights with respect to refunds and returns.
Returns and refunds
If you are concerned about your entitlement to a refund or exchange, we recommend that you read on to learn about your rights and our obligations to you.
A digital product purchased from Newborn Posing is shipped as a download or accessed by logging into your newborn Posing account, after successful payment has been made.. Please make sure you provide the correct email address when you place your order with us for a digital product.
Refunds are not available for digital products purchased from Newborn Posing, or via the Newborn Posing website.
PHYSICAL PRODUCTS, IN-PERSON WORKSHOPS & EVENTS
The remainder of this Refunds & Returns Policy relates to physical products In-Person Workshops and Events purchased from Newborn Posing, or via the Newborn Posing website.
Your entitlement to a refund or exchange
You will be entitled to a refund or exchange where we are required to do so under any relevant laws, including the Australian Consumer Law. You may ask for a refund or exchange if an item has a major problem or is significantly different to what you asked for.
In the event that you believe that you are entitled to a refund or exchange, you must provide us with:
- your full name and address;
- the original order number; and
- the reason for claiming the refund or exchange.
You will not be entitled to a refund or exchange where you have simply changed your mind, so please choose products carefully.
Returning items to us
If you wish to return an item to us, we recommend that you do so as soon as possible after becoming aware of the issue prompting your request for a refund or exchange.Delayed claims for refunds or exchanges may lead to your request for an exchange or refunds being rejected.
We reserve the right to assess the condition of a returned item prior to offering a refund or exchange. This may result in a refund or exchange being refused by us. You may be entitled to a refund equal to the cost of the item only. You may be entitled to an exchange for an identical item, or one of a similar value.
How to return items:
Package the item/s in a shipping bag or box that will prevent damage in transit. We recommend similar packaging to what you originally received the item/s in. If possible, include the original box for the returned item.
Newborn Posing takes no responsibility for items that are returned but become lost or not delivered to us. If you are concerned about loss or damage in transit, you should consider adding tracking or insurance. However, this is at your sole discretion, and Newborn Posing makes no representations or warranties in relation to the security of returned item/s.
Send the item/s to Newborn Posing at22 Spine Street, Sumner, Queensland, Australia 4074.
Upon receipt of the item/s, we will inspect them and if they are returned in accordance with this Refunds & Returns Policy and we are satisfied that you are entitled to a refund or exchange, we will issue you with a refund or exchange.
Return delivery charges
We recommend you return the item to us via Registered Post so that the delivery can be tracked. All shipping costs will be the responsibility of the customer, until such time that we have confirmed that there is a fault with a product or that we have made a shipping error.
Provision of refunds or exchanges to you
If after assessing the condition of the returned item/s, your refund is approved, we will send you an email confirming that your refund will be issued. Refunds will generally be processed within five (5) to seven (7) days of our receipt of returned items.
All refunds will be issued via the same payment method used to purchase the items. There may be delays in the provision of the refund that may be caused by the issuing bank. Please contact us if you have not received your refund within five (5) days of us notifying you that a refund has been issued.
If for any reason, Newborn Posing is required to cancel an In-Person Workshop, we will provide you with a full refund of any money that you have paid to us, in relation to the cancelled workshop.
We will not make any refund for any In-Person Workshop, unless we are required to do so under any law.
If, for any reason, you are unable to attend the In-Person Workshop that you have booked with us, and you have paid the total amount for the relevant workshop, you may transfer or on-sell your booking for the In-Person Workshop to a third party. Please let us know of any such transfer or on-sale, as soon as possible, so we can confirm details of the third party and make appropriate arrangements with them.
If for any reason, Newborn Posing is required to cancel an Event, we will provide you with a full refund of any money that you have paid to us, in relation to the cancelled event.
We will not make any refund for any event, unless we are required to do so under any law.
If, for any reason, you are unable to attend the event that you have booked with us, and you have paid the total amount for the relevant workshop, you may transfer or on-sell your booking for the event to a third party. Please let us know of any such transfer or on-sale, as soon as possible, so we can confirm details of the third party and make appropriate arrangements with them.

PURCHASE & SHIPPING TERMS

We would like you to read our Purchase & Shipping Terms carefully to ensure that you are fully aware of your rights when purchasing items (Items) via the Newborn Posing website (our Website).
Your order signifies your agreement to be bound by these Purchase & Shipping Terms, which constitute the agreement between GMA Cards Pty Ltd A.C.N.169 722 267 as trustee for GMA Cards Trust trading as Newborn Posing A.B.N.24 989 551 791 (we, us, our, or Newborn Posing) and you.
You must provide complete and accurate details at the time of making your purchase. You may be required to provide additional details upon our request to ensure the accuracy of your order.
You must enter the correct delivery address and delivery instructions at the time of placing your order. If you enter an incorrect address, Newborn Posing is not obliged to re-send the order to the correct address at our own expense. Please email us immediately if you submit your order and then realise that you have entered an incorrect delivery address or delivery instructions.
Downloadable Digital Products, Actions, Presets and Tutorials
The following terms apply to all Digital Products, Actions, Presets and Tutorials (Digital Products) downloaded via our Website:
- You are entitled to a single licence only;
- You may use a Digital Product for personal and professional use;
- You must not copy, reproduce or modify any Digital Product;
- You must not share, or resell, any part of a Digital Product; and
- You must not upload any part of the Digital Product to any Internet sharing sites or forums.
You agree and acknowledge that:
- all videos accessed via our Website are viewed online only and are not downloadable; and
- all copyright and other intellectual property rights in the Digital Products is owned by Newborn Posing and/or its nominated entity.
All prices quoted on the Website, or pursuant to any enquiry that you may make with us, are in Australian Dollars (AUD) and include GST.
We reserve the right to vary the prices displayed on the Website from time to time and without notice to you.
Our prices do not include insurance or any secondary attempts to deliver Items to you.
Coupons and discounts shall not be applied to in-person workshops or mentoring services.
Newborn Posing accepts payment via PayPal and credit card.
After you make payment for your order, you will receive a transaction confirmation email, which confirms receipt of your order.
In the event that Newborn Posing does not receive cleared funds after 48 hours of you submitting your order, we will email you at the email address nominated in your order to communicate about your payment.
Sales and coupon codes may not be used in association with payment for In-person Workshops.
Payment of deposit
A non-refundable deposit (see workshop details for specific deposit amount) is required to be paid to Newborn Posing, in order to secure your booking and place in our workshop. Once we have received your deposit in cleared funds, you will be added to your chosen workshop.
You will be required to pay the remaining amount (the Balance) to Newborn Posing by no later than two (2) weeks, prior to the date that the workshop is to be held. We will, via email, provide you with a link to where you are to make payment of the Balance.
The Newborn Posing Events (International)
A non-refundable deposit (see event details for specific deposit amount) is required to be paid to Newborn Posing, in order to secure your booking and place in these events. Once we have received your deposit in cleared funds, we will secure your positing in our event.
You will be required to pay the remaining amount (the Balance) to Newborn Posing by no later than six (6) weeks, prior to the date that our event is to be held. We will, via email, provide you with a link to where you are to make payment of the Balance.
We recognise that protection and safety of information relating to your credit card is very important. Therefore, we provide you with a very safe and stress-free online shopping experience.
We do not store your credit card details at any time so consumer confidence and satisfaction is assured at all times.
PROCESSING OF ORDERS
Orders made via our Website will typically be processed within two (2) business days of your order being made and payment being received from us in cleared funds.
You may pick up your order from us at 22 Spine Street, Sumner, Queensland, between the hours of 9am and 4pm (Australian Eastern Standard Time).
Shipping within Australia will be with a courier service booked via the Interparcel service.
Shipping to locations outside of Australia will be with a courier service booked via the Interparcel service.
We cannot guarantee delivery times. However, you should receive delivery of physical products within five (5) and seven (7) business days.
However, there may be times where shipping will take a little longer (for example, during peak times such as Christmas). We will notify you if this is to be the case. If you have not received your Items within our suggested timeframes, please email us your full name and order number and we will investigate on your behalf.
Delivery of your order may also be delayed if you provide us with an incorrect delivery address.
Digital products will be made available to you, once successful payment has been made.
Live content may be watched live, or replayed at any time, and may be accessed from your Library.
CANCELLATION OF ORDERS
Newborn Posing may cancel your order, if for any reason, we are unable to provide you with the Items subject to your order. We will contact you should this occur.
You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from such cancellation.
You are not permitted to cancel an order, unless expressly agreed to, in writing, by Newborn Posing.
ITEMS MISSING FROM AN ORDER
Should any Item be missing from an order, please email us with the order number and the item code or product name of the Item you ordered, and we will make the appropriate investigations. However, Newborn Posing will not be held responsible for lost or damaged items.
REFUNDS AND RETURNS
Any requests for a refund will be handled in accordance with our Refunds & Returns Policy.
By agreeing to these Purchase & Shipping Terms, you also consent to receive further electronic communications from us in relation to the Newborn Posing business, including information relating to items, competitions, promotions, special offers and any other commercial message. Of course, you may email us to unsubscribe at any time.

WORKSHOP REGISTRATION TERMS
Please read the following terms and conditions carefully to ensure that you are fully aware of your rights and obligations when registering for a Kelly Brown In-Person workshop (Workshop), via our website located at www.newbornposing.com (our Website).
Your registration for a Workshop signifies your agreement to be bound by these terms and conditions, which constitute a contract between GMA Cards Pty Ltd A.C.N.169 722 267 as trustee for GMA Cards Trust trading as Newborn Posing A.B.N.24 989 551 791 (we, us, our, or Newborn Posing) and you.
Newborn Posing may, from time to time, vary these terms and conditions and will provide notification via our Website. All amendments will be effective immediately upon a notification being displayed on our Website.
You must provide complete and accurate details at the time of registering for a Workshop. You may be required to provide additional details upon our request to ensure the accuracy of your registration.
All registrations for a Workshop must be made via the Website.
All prices displayed on our Website are in Australian Dollars (AUD) and include Goods and Services Tax (GST). International orders will not contain GST.
We reserve the right to vary the prices displayed in connection with a Workshop from time to time and without notice to you.
You may pay for a Workshop via any payment method stated as being accepted on our Website, or via any other payment method that we agree to accept.
Once we have received your deposit (as required by us) for a Workshop in cleared funds, we will confirm your registration and provide you with relevant updates leading up to the Workshop that you have registered for.
You will only be able to attend and participate in a Workshop that you have registered, and paid for, in full.
We process registrations on business days only, which are Monday to Friday and exclude public holidays in Queensland, Australia. All registrations made on a non-business day will be processed on the next business day.
If, after registering for a Workshop, you wish to change your registration to a different Workshop, then you may do so by providing us with at least 14 days’ written notice. You will not be permitted to make any such change if you do not provide us with written notice at least 14 days before the Workshop, which you have registered for, is due to commence.
You agree and acknowledge that we may not, and are not obliged to, hold any future Workshop, in any location. Therefore, you may be required to travel to a different location (potentially, outside of your own country) to attend an alternate Workshop.
You may transfer your registration to a Workshop to another person. In the event that you do transfer your registration to another person, then you must provide us with details of the new Workshop attendee, as soon as possible after the transfer has taken place.
Cancellation of Registrations
Cancellation by you
All registrations for a Workshop are final and cannot be cancelled by you.
Cancellation by Newborn Posing
We may cancel your registration for a Workshop, if for any reason, we are unable to hold a Workshop that you have registered for. We will provide you with a full refund of the purchase price for the Workshop/s that you have registered for and that we are unable to provide.
You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from our cancellation of a Workshop.
All fees paid in association with your registration in a Workshop are non-refundable, unless we are required to make a refund under the Australian Consumer Law.
Please email us if you feel that you are entitled to receive a refund from us.
All material contained in, or connected with, a Workshop are owned or under licence by Newborn Posing and protected by Australian and international laws.
Your participation in a Workshop does not grant you a licence or act as a right of use of any of the course material, or trade marks or logos, whether registered or unregistered, contained in, or connected with, a Workshop without the express written permission of Newborn Posing.
Newborn Posing owns the copyright, which subsists in all creative and literary works that are contained in, or connected with, a Workshop subject to certain works being under licence. You must not:
- reproduce or use any of the material contained in, or connected with, a Workshop; or
- in any way modify the material contained in, or connected with, a Workshop.
In summary, you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute any material or trade mark connected with a Workshop in any way except as expressly provided for by contained in, or connected with, a Workshop.
Enforcement of our intellectual property rights
Newborn Posing will not tolerate infringement of its intellectual property, whether such infringement is inadvertent or otherwise. In the event that you do any of the prohibited acts as listed above or infringe upon its intellectual property in any other way, Newborn Posing will enforce its intellectual property rights against you.
Permission to be filmed
By registering and attending any Workshop, you agree that:
- Newborn Posing may film you and your participation in a Workshop and use that recorded material for commercial purposes; and
- you will not be entitled to receive any benefit, monetary or otherwise, if Newborn Posing use the recorded material (as referred to directly above) for commercial purposes.
The information presented in a Workshop is to only serve as general information only. It is not intended to be comprehensive, nor does it constitute advice in any way. We attempt to ensure that the content is current and accurate, but we do not guarantee its currency and accuracy. You should carry out your own research and/or seek your own advice before acting or relying on any of the information presented in a Workshop. To the fullest extent permitted by the law, in material contained in, or associated with, a Workshop disclaims all liability (whether arising by negligence or otherwise) to any person, in respect of action taken in reliance on the information.
You acknowledge, accept and agree that by enrolling in a Workshop, you are fully responsible for your progress and the results derived from your participation in a Workshop. To the extent permitted by law, including but not limited to any act or omission on your part, we will not be liable for any loss, damage, costs or expense whether direct, indirect, incidental, special and/or consequential, including loss of profits, suffered by you or claims made against you which result from any use or access of, or any inability to use or access, information relating to a Workshop.
Certificate of completion
We will issue you with a certificate for completing a Workshop.
